Terms and Conditions
General Terms
These Terms and Conditions consist of three parts:
a) Part 1 – Definitions and General Terms
b) Part 2 – STUFF4.SALE Terms and Conditions of Use, which set out the terms and conditions governing use of the Service
c) Part 3 – STUFF4.SALE Conditions of Sale, which set out the terms and conditions applicable if you become a Purchaser of Goods.
STUFF4.SALE may amend these Terms and Conditions at any time by providing notice of the amended Terms and Conditions. Continued use of the Service following such notice constitutes acceptance of the amended Terms and Conditions.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada.
Part 1 – Definitions
“Auction” means the competitive process employed by STUFF4.SALE to determine a Purchaser for the Goods.
“Goods” means the goods offered for sale through Auctions conducted on the Website.
“Purchaser(s)” means the party or parties who have the legal capacity to enter into a contract,
who were the successful bidders of the Goods in the Auction, and who agree to make payment and take title to the Goods.
“Service” means the STUFF4.SALE auction service offered through the Website.
“Website” means the STUFF4.SALE website located at www.stuff4.sale.
Part 2 – STUFF4.SALE Terms and Conditions of Use
1. User Registration
Use of the Service is limited to persons who may lawfully enter into and form contracts under the laws of Alberta.
Without limiting the foregoing:
•
The Service is not available to persons under the age of 18
•
The Service is not available to persons whose access has been terminated by STUFF4.SALE
Users are responsible for ensuring that registration information is:
•
complete
•
accurate
•
current
Users may not register or place bids using:
•
a false identity
•
false information
•
misleading information
Providing inaccurate or misleading information constitutes a breach of these Terms and Conditions.
Users are responsible for maintaining the confidentiality of their password and for all activities conducted under their account.
2. User Conduct
Users are strictly prohibited from:
•
interfering with another user's transaction
•
placing bids for the purpose of artificially increasing or manipulating prices
•
manipulating the bidding process
•
influencing user behavior on the Website through fraudulent activity.
Any such activity may result in account suspension or termination.
3. Irrevocable Bids
All bids are final and irrevocable.
Once a bid has been submitted, it cannot be withdrawn or removed.
4. Proxy Bidding
The Service may include an automatic bidding feature called Proxy Bidding.
Proxy bidding allows a bidder to enter the maximum amount they are willing to pay for a Good.
The system will automatically increase the bid on the bidder's behalf in increments specified for the item, only as necessary to maintain the highest bid position.
The bidder’s maximum amount remains confidential.
If another bidder exceeds the maximum proxy bid amount, the bidder will be outbid and notified.
If no higher bid is placed before the auction closes, the Goods will be sold to the proxy bidder.
5. Personal Information
STUFF4.SALE collects personal information under Section 33(c) of the Freedom of Information and Protection of Privacy Act (FOIP) as required for operation of the Service.
Information collected may include:
•
registration details used to create a user account
•
IP address
•
domain name
•
date and time of access
•
elapsed session time
•
request types
•
files requested
•
data transmitted and received.
The Website does not use cookies.
Under Section 39(1) of the Freedom of Information and Protection of Privacy Act, this information may be used to:
•
identify users
•
track bids
•
correct email routing errors
•
improve website functionality and design
•
ensure users receive appropriate information and services
•
obtain feedback
•
analyze usage statistics and trends.
6. Copyright
STUFF4.SALE retains all copyright and intellectual property rights related to:
•
the Website
•
its logos
•
design marks
•
all documents and materials provided through the Service.
No materials may be reproduced without permission.
7. Reliance on Service
Users should not rely exclusively on the Service as their sole method of evaluating Goods.
Independent research and inspection of items listed for sale is strongly recommended.
8. No Warranties
The Service is provided “as is” without warranty of any kind.
STUFF4.SALE does not warrant that:
•
the Service will be uninterrupted
•
the Service will be error-free
•
information provided will be complete or accurate.
9. Limitation of Liability
STUFF4.SALE shall not be liable for any loss, damages, or claims arising from:
•
reliance on the Service
•
use of the Website
•
failure or interruption of the Service.
10. Discontinuance of Service
STUFF4.SALE reserves the right to modify, suspend, or discontinue the Service at any time without notice.
11. Withdrawal of Registration
Users may withdraw their registration by sending a request to:
admin@stuff4.sale
12. Remedies Available to STUFF4.SALE
If a user breaches these Terms and Conditions, STUFF4.SALE may take any action deemed necessary, including:
•
issuing warnings
•
removing bids
•
suspending accounts
•
terminating user access.
13. Purpose of Service
The Service is provided solely for the purpose of:
•
viewing auctions
•
bidding on Goods
•
buying and selling Goods through the Website.
The Service may not be used for any other purpose.
Part 3 – STUFF4.SALE Conditions of Sale
1. Obligation to Complete Transaction
If you are the successful bidder in an Auction, you are legally obligated to complete the purchase transaction.
2. Condition of Goods
All Goods are sold “AS IS, WHERE IS.”
Descriptions are based on information supplied to STUFF4.SALE.
STUFF4.SALE makes no warranties or representations, expressed or implied, regarding:
•
condition
•
performance
•
quality
•
merchantability
•
fitness for purpose
•
accuracy of description.
Purchasers are responsible for performing their own inspections and due diligence.
3. Title and Ownership
Ownership of Goods transfers to the Purchaser upon receipt of full payment and removal of the Goods, unless otherwise stated.
4. Entire Agreement
These Conditions of Sale, together with the STUFF4.SALE Sales Receipt, constitute the entire agreement regarding the purchase of Goods.
Time is of the essence in all transactions.
5. Adjustments and Withdrawals
STUFF4.SALE reserves the right to withdraw Goods from sale.
If Goods cannot be transferred due to withdrawal, loss, or error, STUFF4.SALE liability is limited to refund of the purchase price.
6. Payment
Payment Timeline
Unless otherwise stated in the auction listing, payment must be made within three (3) business days after the Purchaser receives notification of winning the auction.
Accepted Payment Methods
For purchases $9,999.99 or less:
•
Visa
•
MasterCard
•
American Express
•
Visa Debit
•
other methods listed in the auction
For purchases over $9,999.99:
•
certified cheque
•
Canadian bank draft
•
other methods specified in the auction listing.
Payment must be received before Goods may be removed.
7. Taxes
All applicable taxes including GST or HST will be applied in accordance with the Excise Tax Act (Canada).
8. Failure to Remit Payment
If payment is not made:
STUFF4.SALE may:
•
cancel the sale
•
resell the Goods
The defaulting bidder:
•
forfeits any money paid
•
remains responsible for any resale deficiency
•
must cover all related costs including advertising, handling, and storage.
STUFF4.SALE may also ban the bidder from future auctions.
9. Removal of Goods
Unless otherwise stated, Purchasers must pack, load, and remove Goods at their own expense within three (3) business days after notification that the Goods are ready.
10. Failure to Remove Goods
If Goods are not removed within the required time:
STUFF4.SALE may:
•
cancel the sale
•
resell the Goods
The Purchaser forfeits all payments and remains responsible for costs associated with resale.
11. Identification Requirements
To collect purchased Goods, the Purchaser must present:
1. Sales Receipt
The Online Auction Sales Receipt
2. Government ID
One government-issued photo identification showing:
•
name
•
address
•
photograph
•
signature
Examples include:
•
driver’s license
•
passport
3. Additional Identification
One or more of the following:
•
health care card
•
credit card
•
debit card
•
employee ID
•
social insurance number card.
STUFF4.SALE may also require the credit card used for payment to be presented.
If sufficient identification cannot be provided, the auction may be nullified and payment refunded.
12. Damage to Property
Purchasers are responsible for any property damage caused during the removal of Goods.
13. Limitation of Liability
STUFF4.SALE is not responsible for any claims arising from:
•
sale
•
handling
•
removal
•
transportation
•
use
•
dismantling
•
decontamination
•
destruction of Goods.
The Purchaser agrees to indemnify and hold harmless STUFF4.SALE and its employees, agents, and contractors from any such claims.
14. Shipping
Three shipping arrangements may apply:
a) Pre-Arranged Shipping
Shipping cost will be listed in the item description.
Items will ship within 48 hours of receiving payment using Canada Post Expedited Parcel, requiring a signature.
b) Arranged Shipping
Shipping cost will be determined after the destination is known.
Buyers will be notified of the cost prior to payment.
c) No Shipping Available
The Purchaser is responsible for all packaging, shipping, and pickup arrangements.
Items must be collected within three (3) days of auction end.
15. Additional Conditions
Any additional conditions applicable to a specific auction will be:

included in the item description or
•
attached as Appendix A to these Conditions of Sale
