Terms and Conditions
General Terms
These Terms and Conditions consist of three parts:
a) Part 1 – Definitions and General Terms
b) Part 2 – STUFF4.SALE Terms and Conditions of Use, which set out the terms and conditions governing use of the Service
c) Part 3 – STUFF4.SALE Conditions of Sale, which set out the terms and conditions applicable if you become a Purchaser of Goods.
STUFF4.SALE may amend these Terms and Conditions at any time by providing notice of the amended Terms and Conditions. Continued use of the Service following such notice constitutes acceptance of the amended Terms and Conditions.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada.
Part 1 – Definitions
“Auction”
means the competitive process employed by STUFF4.SALE to determine a Purchaser for the Goods.
“Goods”
means the goods offered for sale through Auctions conducted on the Website.
“Purchaser(s)”
means the party or parties who have the legal capacity to enter into a contract, who were the successful bidders of the Goods in the Auction, and who agree to make payment and take title to the Goods.
“Service”
means the STUFF4.SALE auction service offered through the Website.
“Website”
means the STUFF4.SALE website located at www.stuff4.sale.
Part 2 – STUFF4.SALE Terms and Conditions of Use
1. User Registration
Use of the Service is limited to persons who may lawfully enter into and form contracts under the laws of Alberta.

Once a bid has been submitted, it cannot be withdrawn or removed.
4. Proxy Bidding
The Service may include an automatic bidding feature called Proxy Bidding.
Proxy bidding allows a bidder to enter the maximum amount they are willing to pay for a Good.
The system will automatically increase the bid on the bidder's behalf in increments specified for the item, only as necessary to maintain the highest bid position.
The bidder’s maximum amount remains confidential.
If another bidder exceeds the maximum proxy bid amount, the bidder will be outbid and notified.
If no higher bid is placed before the auction closes, the Goods will be sold to the proxy bidder.
5. Personal Information
STUFF4.SALE collects personal information under Section 33(c) of the Freedom of Information and Protection of Privacy Act (FOIP) as required for operation of the Service.

Part 3 – STUFF4.SALE Conditions of Sale

If you are the successful bidder in an Auction, you are legally obligated to complete the purchase transaction.

All Goods are sold “AS IS, WHERE IS.”

These Conditions of Sale, together with the STUFF4.SALE Sales Receipt, constitute the entire agreement regarding the purchase of Goods.
Time is of the essence in all transactions.
5. Adjustments and Withdrawals
STUFF4.SALE reserves the right to withdraw Goods from sale.
If Goods cannot be transferred due to withdrawal, loss, or error, STUFF4.SALE liability is limited to refund of the purchase price.

Unless otherwise stated in the auction listing, payment must be made within three (3) business days after the Purchaser receives notification of winning the auction.

All applicable taxes including GST or HST will be applied in accordance with the Excise Tax Act (Canada).

a) Pre-Arranged Shipping

Items will ship within 48 hours of receiving payment using Canada Post Expedited Parcel, requiring a signature.
b) Arranged Shipping
Shipping cost will be determined after the destination is known.
Buyers will be notified of the cost prior to payment.
c) No Shipping Available
The Purchaser is responsible for all packaging, shipping, and pickup arrangements.
Items must be collected within three (3) days of auction end.
